These Terms of Use & Service (“Terms”) govern your access to and use of the Next Level Concierge website and your relationship with ASW Consulting LLC d/b/a Next Level Concierge (“Next Level Concierge,” “we,” “us,” or “our”).
By accessing our website, submitting an inquiry, requesting a quote, booking a service, purchasing a service, or otherwise engaging with Next Level Concierge, you agree to these Terms.
If you do not agree to these Terms, please do not use our website or services.
1. About Next Level Concierge
Next Level Concierge is a luxury concierge and lifestyle-management company based in Charlotte, North Carolina, serving clients locally and nationally.
Our services may include personal concierge assistance, lifestyle management, household support, errand and task management, travel and event assistance, property-related support, senior and family assistance, vendor coordination, and other concierge services agreed upon with a client.
Services vary based on the client's needs and may be provided directly by Next Level Concierge or, when appropriate, coordinated through independent vendors or service providers.
2. Service Requests and Consultations
Submitting an inquiry through our website does not automatically create a client relationship or guarantee that a requested service will be accepted.
We may evaluate each request based on:

We reserve the right to decline a service request.
A service is not confirmed until Next Level Concierge has accepted the request and any required agreement, payment, deposit, or other booking requirement has been completed.
3. Personalized Services
Concierge services are personalized and may differ from client to client.
The exact services to be provided, pricing, timing, deliverables, and applicable requirements may be established through a written proposal, estimate, service agreement, invoice, booking confirmation, or other written communication.
If a separate written service agreement exists between you and Next Level Concierge, that agreement will control in the event of a conflict with these general Terms regarding the specific services covered by that agreement.
4. Pricing and Payment
Prices may vary depending on the type, complexity, duration, location, urgency, and resources required for a requested service.
Unless otherwise stated:

A quote or estimate is not a guarantee of final cost when the scope of work changes.

Additional services requested after approval may result in additional charges.

Third-party expenses, vendor fees, delivery charges, travel expenses, admission fees, reservations, materials, and other out-of-pocket costs may be charged separately.

Required deposits or advance payments must be paid before services requiring such payment are confirmed.

Clients are responsible for providing accurate billing information.
Payment terms, deposits, cancellation fees, retainers, or other charges applicable to a particular service may be stated in the applicable proposal, invoice, booking confirmation, or service agreement.
5. Third-Party Vendors
Some services may require us to coordinate with independent third parties, including:

Unless expressly agreed otherwise in writing, third-party providers are independent businesses and are responsible for their own services, pricing, performance, licenses, insurance, and policies.
When reasonably appropriate, we may assist with communication and coordination between the client and third-party provider.
6. Client Responsibilities
Clients agree to:

Provide accurate and complete information necessary to perform requested services.

Provide timely instructions, approvals, access, and information.

Notify us of relevant changes affecting a service.

Provide safe access to locations when required.

Pay invoices and approved expenses when due.

Obtain any permissions or authorizations necessary for us to perform requested services.

Treat Next Level Concierge personnel, contractors, and vendors respectfully and professionally.

Avoid requesting services that are illegal, unsafe, fraudulent, deceptive, or outside the lawful scope of our business.
A delay caused by incomplete information, unavailable access, failure to provide approvals, or other client-related circumstances may affect the timing or cost of a service.
7. Property Access and Client Assets
Some concierge services may involve access to homes, vehicles, offices, vacation properties, packages, personal belongings, documents, keys, access codes, or other property.
Clients are responsible for providing accurate access instructions and notifying us of relevant security requirements.
We will use reasonable care when handling client property within the scope of an agreed service.
Clients should not provide unnecessary passwords, financial credentials, Social Security numbers, or other highly sensitive information.
Where possible, clients should use temporary access codes or other limited-access methods rather than sharing permanent credentials.
8. Safety and Right to Refuse Service
The safety of our clients, personnel, vendors, and the public is a priority.
We may refuse, pause, modify, or terminate a service if we reasonably believe that:

The requested service presents an unsafe condition.

A location is unsafe or inaccessible.

Illegal activity is involved.

The request requires conduct outside our lawful authority or professional capabilities.

A client, household member, vendor, or other person behaves abusively, threateningly, or inappropriately.

Conditions materially differ from those represented when the service was booked.
If a service must be stopped because of unsafe or unlawful conditions, applicable charges may still apply for services already performed or expenses already incurred.
9. No Emergency Services
Next Level Concierge is not an emergency response service, medical provider, law-enforcement agency, fire department, or emergency transportation provider.
Our concierge services are not intended to replace emergency, medical, legal, financial, or other licensed professional services.
If you or another person is experiencing an emergency, contact the appropriate emergency or professional service directly.
10. No Professional Advice
Unless specifically stated otherwise, Next Level Concierge does not provide legal, medical, financial, tax, investment, insurance, mental-health, or other professional advice.
Information provided through our website or during concierge coordination is intended for general informational and logistical purposes.
Clients should consult appropriately licensed professionals for professional advice.
11. Cancellations and Rescheduling
Cancellation and rescheduling terms may vary by service. Because concierge services may involve advance scheduling, vendor commitments, reservations, travel arrangements, or other non-refundable expenses, clients may be responsible for costs incurred before cancellation.
Any cancellation fees or specific notice requirements applicable to a service will be disclosed in the applicable service agreement, proposal, booking confirmation, or other written communication.
12. Client Confidentiality
We understand that concierge relationships may involve private information about a client's household, schedule, travel, property, family, preferences, and personal affairs.
We will handle client information in accordance with our Privacy Policy and applicable law. However, confidentiality does not mean absolute secrecy. We may disclose information when reasonably necessary to provide a requested service, protect safety, comply with legal obligations, respond to lawful requests, or protect our rights and property.
Additional confidentiality obligations may be established through a separate client agreement.
13. Website Content
The content on this website is provided for general informational purposes.
We make reasonable efforts to keep website information accurate and current, but we do not guarantee that all content is complete, current, or error-free.
We may change, update, suspend, or discontinue portions of the website at any time.
14. Intellectual Property
Unless otherwise stated, the Next Level Concierge name, logo, branding, website content, written materials, graphics, photographs, designs, text, and other original materials are owned by or licensed to Next Level Concierge and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, publish, sell, or commercially exploit our materials without our prior written permission.
15. User Submissions
If you submit reviews, testimonials, photographs, comments, suggestions, or other content to us, you represent that you have the right to provide that content.
We will not use a client's name, photograph, testimonial, or identifying information for marketing purposes without appropriate authorization or permission where required.

Our website may contain links to third-party websites or services.
These links are provided for convenience and do not necessarily constitute an endorsement.
Next Level Concierge is not responsible for the content, availability, security, privacy practices, or services provided by third-party websites.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Next Level Concierge and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
To the fullest extent permitted by applicable law, our liability relating to a particular service will be limited to the amount actually paid by the client to Next Level Concierge for the specific service giving rise to the claim.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
18. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Next Level Concierge, its owners, employees, contractors, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from:

Before initiating formal legal proceedings, the parties agree to make a good-faith effort to resolve any dispute through direct communication.
Nothing in these Terms prevents either party from seeking emergency or legally available injunctive relief or from exercising rights that cannot lawfully be waived.

Updated Terms will be posted on this website with a revised “Last Updated” date.
Your continued use of the website or services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
21. Severability

These Terms, together with any applicable proposal, invoice, booking confirmation, service agreement, or other written agreement between you and Next Level Concierge, constitute the applicable agreement concerning your use of our website and services.
